WOR check: which participation body is required — and does your decision need advice or consent?

Use your headcount to establish which body the Dutch Works Councils Act requires — a works council from 50 employees, a staff meeting from 10 — test your current situation against it, and check whether a proposed decision falls under the Art. 25 advice right or the Art. 27 consent right.

02Executives with a proposed decision who want to know before deciding whether advice or consent is required, and in what order.
03Works council members and secretaries who want to look up the basis of a right before assessing a request.

What the tool does

✓ Required body based on headcount (persons, not FTE): works council from 50, staff meeting from 10, no statutory obligation below that✓ A test of your current body against the required body, with the reason it does or does not suffice in each situation✓ A decision check across 26 subjects: thirteen requiring consent (Art. 27) and thirteen requiring advice (Art. 25), with the article reference✓ The procedural steps that go with the right found, including the warning that a decision taken without consent may be void✓ A flag for a group or corporate structure (Art. 33 WOR) as a point of attention alongside the outcome✓ Reference material in the report: the Art. 25 and 27 subject lists, information rights and works council facilities

Two questions that are easily conflated

Whether you must have a participation body, and whether a specific decision must go through it, are two different questions. The first depends only on headcount: a works council from fifty, a staff meeting between ten and forty-nine, nothing required below that. The second depends only on the subject: a scheme on pay or working hours falls under the consent right, a reorganisation or acquisition under the advice right.

The distinction between advice and consent is not a matter of degree. With consent, a decision implemented without consent and without substitute authorisation from the sub-district court may be void — the heaviest sanction the Act provides. With advice, the issue is timing: advice must be sought while it can still materially influence the decision. The check gives the type, the article reference and the accompanying procedural steps per decision, and records that in a report with tool version and dataset vintage.

Frequently asked questions about this tool

Do I count employees or FTE?
Persons. The Act’s thresholds concern the number of people working in the undertaking, not full-time equivalents. An organisation with sixty part-timers therefore passes fifty and needs a works council, even though its FTE count is lower.
Can I rely on the article reference given?
Treat it as a starting point, not a final ruling. The article references come from the source tool and their lettering is inconsistent with the statutory text on several entries. Every decision result therefore carries a notice that the reference is indicative and must be checked at wetten.overheid.nl. The advice-versus-consent distinction remains the usable part of the outcome.
Does the decision check take my company size into account?
No. A decision is classified as requiring advice or consent on its subject alone; the headcount and the body in place play no part. Formally the Art. 25 and 27 rights belong to a works council, and an employee representation body has a narrower consent right. The report flags this explicitly when you test a decision at a small organisation.
Does the list contain every Art. 25 and 27 subject?
The check covers 26 decisions: thirteen requiring consent and thirteen requiring advice. That is not the complete enumeration of either article — the report does include the broader subject lists as reference material, so you can see whether your decision falls outside it.
