VAT and real estate — the option to tax, delivery and revision in one assessment

Assess three real estate situations with one rule set: whether the option to tax a lease holds on the percentage of taxed use, how a supply works out for VAT and transfer tax — a new building within the two-year window, building land, an opted supply or exempt — and what a change in use means for the revision of a capital good over the remaining years.

Who it’s for

01Real estate and VAT advisers who want to record per property whether the option holds and what the revision exposure is.
02Landlords of commercial premises who need to know whether a tenant with partly exempt activities jeopardises the option.
03Buyers and sellers of property who want to know before completion whether VAT, transfer tax or the concurrence exemption applies.

What the tool does

✓ The option to tax tested against the 90% norm, or 70% for education, sport, culture and healthcare, with a borderline flag within ten points✓ Revision exposure on a renovation: the annual revision and the remaining amount over the years left in the ten-year period✓ Supply outcomes for building land, a new building inside and outside the two-year window, an opted supply and an exempt supply✓ Transfer tax per outcome: the concurrence exemption, the commercial rate, the main-residence rate, the rate for other dwellings or the starter exemption✓ Capital-good revision over ten years with the annual correction, its direction — repay or reclaim — and a year-by-year table to the end of the period✓ Sub-letting and mixed-use flags, plus the legal basis with every outcome

The option is not the end but the start of ten years

Taxed letting is permitted only while the tenant uses the property at least ninety per cent for taxed activities — seventy per cent in the designated sectors. If that percentage drops, the option lapses, and that feeds through to the VAT recovered on acquisition or renovation: it is revised over the years remaining in the ten-year period. Which is why a figure of eighty-five is not a comfortable margin but a point of attention: not a problem today, but a risk that returns every year.

For a supply the pivots are different: does the object fall within two years of first use, is it building land, or has the parties opted for a taxed supply. Each of those routes determines not only whether VAT applies but also whether the concurrence exemption from transfer tax does — and that difference runs into the tens of thousands quickly. The tool gives the outcome per situation with its legal basis, and records it with the tool version and the dataset vintage.

Frequently asked questions about this tool

Does the tool calculate amounts of VAT or transfer tax?
For the revision it does: those amounts are computed from the VAT recovered and the change in taxed use. For a supply it does not: there the tool determines which treatment applies and the rate that goes with it according to the dataset, without computing an amount. No purchase price is asked in that scenario.
What happens with a dwelling or mixed-use property in the rental route?
Letting a dwelling is exempt and the assessment stops there: the tool gives that outcome without using the other inputs. For a mixed-use property the tool asks the residential percentage and runs the percentage test for the commercial part. The residential part is always exempt (Article 11(1)(b) Wet OB 1968) and can never fall under the option; the tool says so emphatically and asks you to assess the residential part as a separate case.
How firm are the transfer tax percentages?
They come from the dataset vintage stated in the report. The rate for a dwelling that will not be a main residence is explicitly marked in the source as still to be verified, and the extension of the 70% norm to a taxed supply carries contradictory notes in the source too. Use the outcome as a qualification and check the percentage before computing with it.
Which date does the two-year window use?
The intended delivery date you enter, set against the date of first use. That is deliberate: the outcome is then reproducible and not dependent on the day you run the calculation. In the revision scenario you enter the current year for the same reason.
