Test the customary DGA salary — the highest of three criteria, with the tax impact of a shortfall

Test a director-shareholder salary against Art. 12a Wet LB 1964 for 2023–2026: the required salary is the highest of the most comparable employment, the highest-paid employee and the statutory minimum. The tool shows which criterion governs, how large any shortfall is and what it indicatively costs in additional payroll tax.

Who it’s for

01Tax advisers and accountants who set the DGA salary each year and want the substantiation on file.
02Director-shareholders of their own BV who want to know whether their current salary passes the test and what a correction would cost.
03Payroll administrators who must recalculate the customary salary per part-time percentage when working hours change.

What the tool does

✓ Three criteria side by side: most comparable employment, highest employee salary, and the statutory minimum — with the governing criterion flagged✓ Statutory minima per year from the vintage: € 51,000 (2023), € 56,000 (2024 and 2025) and € 58,000 (2026)✓ Part-time weighting: the comparable salary and the minimum scale with your FTE percentage, the highest employee salary does not✓ A binary outcome without the efficiency margin — abolished from 2023 — with the shortfall in euros and as a percentage✓ Indicative additional payroll tax on the shortfall, computed across the Box 1 brackets the shortfall spans✓ Threshold exception: where the required salary is below € 5,000 the rule does not apply

Why “the highest of three” so often surprises

Since 2023 the customary-salary rule has no efficiency margin: the required salary is exactly the highest of the three criteria, with no discount. That shifts the discussion from the margin to the question of which criterion governs — and it is by no means always the statutory minimum. As soon as an employee earns more, or a comparable role pays better, that criterion lifts the required salary in one step.

Part-time work widens the gap. The comparable salary and the statutory minimum are weighted by your working hours; the highest-paid employee’s salary acts as a fixed reference and does not scale. A director at 60% can therefore land on a required salary above the pro-rated minimum. The tool puts the three amounts side by side, flags the governing criterion and records the outcome with tool version and dataset vintage, so the substantiation is still traceable years later.

Frequently asked questions about this tool

Which years does the test cover?
2023 through 2026 — the regime as it applies from 2023. For 2021 and 2022 the 75% efficiency margin still applied; for those years the tool returns no outcome but a notice that the tax year is unsupported. For 2025 and 2026 the statutory minima are confirmed, but the brackets and rates used for the tax impact are marked indicative in the source; the report states that.
Why isn’t the highest employee salary pro-rated for part-time work?
Because the tool treats that criterion as a fixed reference: the highest-paid employee’s salary enters the comparison unweighted, while the comparable salary and the statutory minimum are multiplied by your FTE percentage. If you work part-time and there is a high-earning employee, that criterion is flagged separately in the breakdown, so the effect is visible rather than hidden.
What does the € 5,000 threshold exception mean?
If the required salary comes out below € 5,000 — for instance at a very small part-time percentage with no comparable role — the customary-salary rule does not apply, and the tool reports that outcome. In that case the actual salary is not tested against the required salary and no tax impact is computed.
Is the additional payroll tax shown the amount of an assessment?
No. It is the tax on the shortfall, computed across the Box 1 brackets the shortfall spans, without tax credits or social security contributions. It gives the order of magnitude of a correction; it is not an assessment, not a penalty, and not an estimate of the likelihood of either.
